The election today is being held 10 order to fill the vacancy caused by the death of Judge Abdullah EI-Erian of Egypt. Before we proceed to the election, I should like to bring the following infonna- tion to the attention of the Assembly. 2. First,' in accordance with General Assembly resolu- tion 264 (Ill), a State which is a Party to the Statute of the International Court of Justice but not a Member of the United Nations may participate in the election in the Gen- eral Assembly with the same rights as the States Mem- bers of the United Nations. On this occasion I am happy to welcome here the representatives of Liechtenstein, San Marino and Switzerland. 3. Secondiy, I shouid iike to draw the attention of the Assembly to the documents relating to the election. The Assembly has before it a memorandum by the Secretary- General [AI361861-SI14885] on the present composition of the Court and the procedure to be followed in the General Assembly and in the Security Council in regard to the election; a note by the Secretary-General containing a list of candidates nominated by national groups [A13618621 Rev.1-SIl4886IRev.1] and a note by the Secretary-General containing the curricula vitae of the candidates [AI361863- SI14887]. 4. Thirdly, in conformity with Article 8 of the Statute of the International Court of Justice, independently of the General Assembly the Security Council will also proceed to the election of one member of the Court. 5.. Fourthly, the re~ult of the voting in one of the organs wIll not be communIcated to the other organ until the vot- ing in both organs is completed. 6. Fifthly, in accordance with Article 10, paragraph 1, of the Statute of the Court, the candidate who obtains an absolute ~ajority of votes in the General As~t;;mJ>ly and in the Secunty Council shall be considered as elected. For *Resumed from the 105th meeting. NEW YORK the present election, 81 votes constitute an absolute majority in the General Assembly. 7. Finally, representatives are requested to use only the ballot papers now being distributed and to place a cross at the left of the name of the candidate for whom they wish to vote. Each elector may vote for oniy one candidate. No names may be written in on the ballot paper, if that is done the ballot will be considered invalid. 8. The General Assembly will now proceed to a secret ballot. I request representatives to remain in the Hall until the result of the voting is announced. If on the first ballot no candidate obtains the required majority, it will be nec- essary to proceed to other ballots until the required major- ity is obtained.
At the invitation of the President, Mr. Hattinga van'T Sant (Netherlands), Mr. Szeremeta (Poland) and Mr. Goonetilleke (Sri Lanka) acted as tellers.
A vote was taken by secret ballot.

As neither candidate has ob- tained the .required absolute majority, the General Assem- . bly will have to vote again. I remind representatives that no names may be written in, and that any ballot paper on which more than one name is marked will be considered invalid.

I have communicated this result to the President of the Security Council. 22. I shall now read the letter dated today, 19 March 1982, from the President of the Security Council ad- eJressed to the President of the General Assembly' commu- nicating the result of the vote in the Council. The letter reads as follows: "I have the honour to inform you that at the 2333rd meeting of the Security Councii, heid on i 9 March 1982 in order to elect a member of the International Court of Justice to fill the vacancy caused .by the death of Judge Abdullah EI-Erian, Mr. Mohammed Bedjaoui received an absolute majority of votes." .. Having obtained the required absolute majority in elec- tions held independently in the General Assembly and the Security Council, Mr. Mohammed Bedjaoui (Algeria) was elected member of the International Court ofJustice for a term of office ending on 5 February 1988 (decision 361309 B). 23. I take this opportunity to extend to Mr. Bedjaoui the congratulations of the Assembly on his election to this high office, and to wish him a successful tenure on the Court.
