17.  Elections to fill vacancies in subsidiary organs * if) Election of the members of the International Law Commission

The General Assembly will pro- ceed to the election of the members of the International Law Commission. 2. In conformity with the provisions of Chapter I of the statute [resolution 174 (11)] of the Commission. the 34 members of the Commission are to be elected for a period of five years, with effect from 1 January 1982. In accord- ance with article 7 of the statute of the Commission and having in mind the decision taken by the Assembly on 18 November 1981 [63rd meeting], the Secretary-General has submitted a list comprising the names in alphabetical order of all the candidates duly nominated. The list appears in the note by the Secretary-General [A/36/3711 Rev. 1-, para. 13] and on the ballot papers which will be distributed for each of the five regional groups. Only those candidates will be eligible for election. 3. Representatives are reminded that according to arti- cles 2 and 8 of the statute, the persons to be elected to the Commission should individually possess the qualifica- tions required-that is to say, they should be "persons of recognized competence in inte111ational law"-and that "in the Commission as a whole representation of the main forms of civilization and of the principal legal systems of the world should be assured". - 4. In accordance with rule 92 of the rules of procedure of the General Assembly, the election will be held by secret ballot. 5. Representatives are requested to mark with a cross the names of the candidates for whom they wish to vote, but not to mark more than the number of candidates pre- scribed for each re.gional group in paragraph 3 of General AsseI111,ly resolution 36/39, namely: nine nationals from African States, eight from Asian States, three from East- ern European States, six from Latin American States, and eight from Western European or other States. NEW YORK didates, up to the number prescribed for each regional group, who obtain the greatest number of votes and not less than a majority of the votes of the Members present and voting, will be declared elected. 6. Ballot papers, marked A, B, C, D and E, will now be distributed. I request representatives to use only thos~ ballot papers and, as I said before, they should place a cross at the left of the names of the candidates for whom they wish to vote, but should not mark more than the maximum number indicated on each ballot. Ballot papers containing more than the maximum number for each group will be declared invalid.
At the invitation of the President, Mr. Klause (Canada), Mr. Mahor:ey (Gambia), Mr. Moncada Zapata (Nic- aragua), !1r. Potocki (Poland) and Mr. Mauala (Solomon Islands) acted as tellers.
A vote was taken by secret ballot.
Since the counting of ballots will take some time, I propose that we suspend the meeting while the tellers count the votes.
The meeting was suspended at 3040 p.m. and resumed at 5.20 p.m.
