I now see that the Gen-. eral Committee~ which' was due to meet again at 6 p.m., will not be able to do so,' There is another·point raised by the representative' of Australia on which I should like, as President, to make a very brief observation. Our Australian colleagile has again mentioned what he calls the arrogation by this Council of a power that prop~rly belongs' to the Assembly in regard to the admission of new Members. l think this is not the first time that the repre-' ~C?ntative of Australia has brought up this matter, and I think the Australian .views on t¥S point. have been rejected by the Council before. Article 4. of, the Charter prl?vides that the Councilwill perform a definite function in regard .·tothe admission of new Members; it states that the Assetnblywill take a decision only cc••• upon the recomIne~dation of the Security Conncil~'. Therefore, if the Security Council did not make a recoznmendatiQ!1 as provided'by the Charter, it would not be fulfilling its functiorts.. I·want to point out that this question has been .. raised on several occasions by the representatives . ofAustralia and. that it has not been accepted by the Council,as a whole. How can we1in reason, entertain this motion on the theory that rule 59 is void? I cannot see that; there is any possible ground for that. ~ On the other point, the point of policy, there were'twogrounds stated. One is that a joint committee has been set up. It matters very little whether that committee has' been organized or not. I am informed through the President's state- ,ment that it is not even organized, but in whatever stage of parliamentary condition this committee may be, and whatever it may have done, if it basnot' accomplished a repeal of rule 59 by the perfection of its work, this Council is bound by rule 59. As a matter of policy, the United States favours regularity and obedience' to the existing law :as long as it exists. . , As regards the second point, that the Treaty of Peace With,Hungary has ,been ratified by only one St~te, while it has not yet been ratified by two other States, even though the applican~, by leiterof 22 April,.seems to state to, us that this is the fact, it is nQt a juridicalfact tous,but would be such if it were reported by the ConUnittee which we set up. 'That letter says: "In this connexion, I wish to draw the attention of Your Excellencyto the fact that the Treaty of'Peace"With Hun~ary ,has already been signed. Therefore, the 'limitations imposed upon 'my country's ,sovereignty by, the Armistice Agreement are of •temporary character and, will lose their effect ,upon the coming into force of said Treaty." , Assuming that this could be juridically true is a matter for US to take cognizance of here; that do~ not 'constitute any reason for deviating from ther'!Jle. Les restrictions que I'accord d'armistice impose a la souverainete ,de mon pays sont donc d'un caractere temporaire et cesseiont avec l'entrce en vigueur du dit Traite~" .Considerons la possibilite que, juridiquement, ceci soit exact; cela ne constitue pas une raison pour s'ecarter' du 'reglement. En regIe 'generale, nous estimons qu'il est preferable de suivre le reglement et de renvoyer,par les voies regulieres, cette demande d'admission au Comite, mentionne a l'artide 59, car si la non-ratification I vois aucune raison pour adopter la-motion soumise par le representant de l'Australie. The,PRESIDENT: Perhaps I shoald say a word for the information of the Council regarding the "position of the General Assembly Committee and the Security Council Committee which are jointly charged with re-examining the procedure goveming the admission of new Members..They are not ,a joint committee; they are two separate Committees. One is the A~embly Committee~ consisting of Australia, Cuba, Illdia,Norway, and the Union of Soviet Socialist Republic,>, appointed on 15 December 1946 by the General .Assembly at its sixty-seventh plenary meeting. The General Assembly was informed at the same meeting that the Security Council had appointed, to l)erve on' its Committee on Procedure, the fol- 10Wing'countries: China, Brazil and Poland_1. As to the other matter, the President may well call a special meeting for the discussion of that subject, either on the ' initiative of the Chair or at the request of some members. I do not think this is the time to go into that subject further. We had better confine oUr discussion to the second point of,the agenda. M. The procedure proposed by the President with r~gard to this second point is correct and in conformity with our rules of procedure; I agree that we should proceed in that manner immediately. It woUld be within the jurisdiction and capacity of the Committee whicl\ is established especially , for such questions to consider the matter and to take into consideration the statement made by the representative of Australia that Hungary is not now a sovereign State, but an enemy State. Mr. GROMYKO (Union of Soviet Socialist Republics): I think it is obvious that the Security Council is not in a position to consider the substance ofthis question at t.his meeting. Therefore, I thinkit would be proper to refer this question to the Commi':tee on Admission of New Members, which will consider at the appropriate time the application received from the Government of Hungary. As to the points raised by the representative of . Australia, I think they are not directly connected with the question under consideration. .The PRESIDENT: The Chair wishes to ask the Syrian and the USSR representatives whether I they are willing, in order to expedite our proceedings, to propose their suggestions as amendments to the Australian motion. The Australian representative moved that the application of Hungary for admission to the United Nations be noted and deferred for consideration to an appropriate time. . I think the obvious procedure is, as I suggested earlier in the meeting, to refer this question to· the Committee on Admission of New Members which, according to our customary procedure, deals with this problem first, before any discussion takes place in the Council. If the Syrian and Soviet representatives are willing to propose their suggescions as an amendment to the Australian motion, I think that we shall put their suggestions to the vote first, before the Australian motion is voted upon. Mr. GROMYKO (Union of Soviet Socialist Republics.): Cannot the two proposals be considered as separate proposals? The PRESIDEl'.'T:.Yes, they can. Mr.GROMYKO (Union of Soviet Socialist Republics): In that case, I would suggest that you consider the second proposal as an amendment to the first proposal. Mr. IU.TZ-SUCHY (Poland): The Polish delegation cannot vote in favour of the Australian motion. I fully agree with the arguments of the Syrian representative: this is neither the place nor the time to discuss all the principal elements which th.... representative of Australia has presented. M. We submit that the resolution and the amendment are quite out of order for these reasons: the Chair put the provisional agendu before us and asked whether there were any observations; the Chair proceeded to make observations; then I spoke. That agenda has not yet been. adopted, and the Chair has not ruled that it is adopted. One cannot submit a motion dealing with a subject on an agenda which has not been adopted.
