Mr, TSARAPJ{TN (Union of Soviet Socialist Republics) (translated from Russ£an): As we all know, the United Nations Charter a11d Article 83 in particular, entrusts all function; of the United Nations relating to the trusteeship of strategic areas la the Security CounCll alone, Article 85 expressly stipulates that the Trusteeship Council shall exercise all functions of the United Nations with regard to TrusteeShip Agreements "for all the areas not designated as strategic", The obove-mentioned Articles of the Cllarter thus leave no doubt that the only United Nations organ empowered to exercise functions of the United Nations relating to strategic areas under trusteesllip is !lIe Secnrity Council. Under Article 83, paragraph 3, the Security Council shall "avail itself of the assistance of the Trusteeship Council to perform those functions of the Ullited Nations under the Trusteeship System relating to political, economic, SOCk'! <Lnd educational matters in the strategic areas". Further, that paragraph deliberately specified that the Security Council shall avail itself of the assistance of the Trusteeship COl1ncil "subject to the provisions of the Trusteeship Agreements and without prejudice to security considerations". Thus, in the exercise of its functions under the Trusteeship System, the Security Council turns for assistance to the Trusteeship Council. Under Article 83, paragraph 3 of the Charter, the Trusteeship Council is, on its part, bound to lend its assistance to the Security C011nci1. As regards strategic areas under trnsteeship, the Trusteeship COlmeil plays only an auxiliary part, while the Security Council plays the prin6p<ll part. The draft resolution fL\rther states that the Security Council, which under the rklrtf'r is alone empowered to perform all the ftJnctions of tl1e United Nations with regard to strategic areas under trusteeship, reqtlests the Trusteeship Coun- cil to perform on its behalf a certain part of :ts functions with respect to those areas, with certain reservations ano sl1bject to certain conditions. There is also a provision to the eff&t that the Trusteeshb Council shall send to the Security Council fo'r preliminary examination a copy of tbe questionnaire which the Trtlsteeship Coundl s11all formulate and forward 10 the Administering Authority. The resolution futiher provides that the TrL1steeship Council shall assist tbe Security Council by examining reports and petitions received from strateg-ic areas and ~hnll report to the Security CQuncil on the results of that examination. Paragrapll 4 of the draft resolution provides that the Trusteeship Council shall "submit to the Security Council its reports ;md recOJTmemlations on political, economic and educational matters affecting strategic areas under trusteeship". In view of thesl1bstance of the above draft resolution, and partiClt!ctrly of the fact that its preamble states that the Trusteeship Council is requested to assist the Secllrity Cocncil in the performance of certain functions of the United Nations relating to strategic areas under trtlstee- shil? in the. :acific Ocean, and gui:!ed hy the deSire to .faaMate the solution of this long drawn- 01-1t question...the USSR de1eg::ttion does not object to the defimbon of the tasks which it is intended to entrust to the Truseeship Cotlncil. The USSR delegation feels obliged to point out, however, tbat the draft resolu~ion of the Committee of Expe~ts lla.~ .one ~hortcomi~g: it is too ge~era1. Accordmg to Its terms, the Security CounCil would determine its relation with tbe Trllste.eship Cou~cil not only as regards strategic areas III t.he PaCific Ocean under U:1ited States Trusteeshtp, for which the Security Coundl has approved a Trusteeship Agreement, but also as regards all areas which mi"ht be placed under trusteeship in the future under terms that are as yd unlmown. Il est en meme temps prevu que le Conseil de tutelle soumettra al'examen au Cons~jl de securite ttn exemplaire tiu questionnaire qu'il est charge d'etablir et d'envoyer a l'Autorite char- gee de l'administratio:l. Etant donne la substance dtl projet de resoh1tio:J en question, la delegation de I'URSS, desireuse de contribuer al1ne solution rapide de cc probleme qui traine en longueur: prend note que, aux termes de ce texte - ainsi que le precise le preambu1e - le Consell de tutelle doit assister le Conseil de securite dans I'exercice de certaines fO\lctions assumees par l'Organisation dcs Nations Unies au titre du Regime de tutelle sur les zones strate~ giques du Pacifique; aussi notre delegation ne s'oppose-t-elk pas a ce '1ue 1'on definisse les dc- voirs que.I'on se propose de confier au Conseil de tutelle. My doubts are more of a juridical na:ure than a political one. As far as interpretations and c!lange~ are con~ cerned whether in paragraph 3 cf Article 27 or any other part of the Charter, I consider that we have to know whether jmisprudence [or such matters which might constitute a change in the Charte; can be a source of legislation in the United 'Nations. I consider that I Owe it to the Council and to my own delegaticn to expla-in my vote today, especially since the representatives of the other two delegr..tions which abstained did have an opportunity of explaining their vote. We r.ave mcst carefully studied the work of the Committee of Experts, and while considering that it has, rela~ively 5peaking, brought its work to a very good conclusion, that conclusion is not sufficiently c\car to ns-and that is why I say "relatively speaking"-nor does it, in Ollr view, sufficiently express that equilibriu;n whic.h the Charter has tried to create with regard to various important considerations. When I speak of "equilibrium", I specifically mean certa:n things. En parlant "d'equilibre", j'avais en vue certnins elements bien precis. TOllt d'abord, je snis certain qu'il apparait nettemcnt a chncun de nGllS que le hicn-etre des, hab:tants du territoire sous tutelle est le but final et l'objectif principal du :egime de tutelle. Or, le COllseil de ttltelle dispose pcecisement des moyens necessaires pour controler l'application des mesures qui doivent etre prises, ou Although my delegation considers that the draft resolution is good, relatively speaking, we consider that it does not sufficiently clarify that equilibrium which the Charter of the 'L~nited Nations wanted to create and to maintain between these various considerations. We are not unhappy that the draft resolution was passed, but we hope that the spirit of the Charter a:J.d the essential purpose for which the whole system of the Trusteeship Council was created will be maintained and ~ept in mind. For the reasons which I have explained, I, on behalf of my ddegation, abstained from voting.
