In that case the Security Council cau perhaps proceed ta discuss the most urgent question before it-the telegram of 5 August from the Minister for Foreign Affairs of the Korean People's Democratie Republic [S/1674] protesting against the barbarous bombing by the United States Air Force of peaceful towns and populated areas in Korea and of the peaceful population. There is a draft resolution on this subject [S/1679] submitted by the USSR delegation on 8 August [484th meeting]. Perhaps we should consider this as a matter of urgency.

Mr. AUSTIN (United States of America): 1 most respectfully request that the President should rule upon the point of arder. There is nothing e1se to do at the present moment except to rule upon the point of order. That is the business of the President and he ought to perform it. We ought not ta waste any more time.

As 1 mentioned in the short summary 1 made at the begïnning of the meeting, the result of the unofficial exchange of views that has taken place between the members of the Security Council on questions arising at the previous meeting has been that the opinions of the parties have remained unchanged, and accordingly we have recognized that such unofficial exchanges of opinions would he advisable in the future. It is therefore hardly advisable to retum to this question, for it is perfectly obvious to an the members of the Security Council that, in the circumstances that have arisen, the President cannot possibly make the ruling upon which the representative of the United States 1lIld the representative of the Kuomintang group have been insisting so vehementIy for the last two meetings.

Mr. AUSTIN (United States of America) : 1 challenge the ruling of the President and calI upon him to put the question to the Security Council. 1 claim that his last ruling is inaccurate. When he Telies upon the statement that he made at the opening of this meeting as a reason for not ,- .,ng UpOll the question that is before him, he is in errL -and he is in error, in addition, when he assigns anj responsibilityfor his position to the other members of the Security Council. 1 calI for the régular order now. It is time that the President Îollowed the rules-just once.
That is not my own view at all. 1 think tbat this is a very grave matter. This impasse which we have reached, and which unfortunately we could not solve or come near solving as a result of our private conversations, is a really serious matter. It is holding us up and, untiI we get over it, we shall not make any further progress. W~ must get over it somehow, and 1 think the oo1y way that we cao get over it is to go on asking the President to give his ruling, as he really ought to do. In th?t respect, 1 have many further arguments to deploy in support of what 1 submit is his real duty as President of the Security Council.
As a matter of fact, 1 shall hope to ponder what has been said today by more than one person, and 1 should, _therefore, hope to deploy my full arguments at the meeting' which 1 trust we shall have tomorrow.
The following situation has arisen. The representative of the United States bas challenged a non-existent ruling. The President has made no ruling, and has announced very clearly and plainly. that, in view of the si~tion which has arisen, he is unable to make a ruling. Therefore, as there is no ruling, the challenge cannot stand. Only a ruling cao be challenged. In this case there was no ruling. The challenge therefore lacks an object.
As regards the United States representative's last statement, that representative has already discussed the substance of the question, having first made a number of slanderous and unfounded allegations in regard to the Soviet Union's position on the question under discussion. _ The USSR delegation bas aIready had ample opportunity, in its two preceding statements, to state the point of view of the Government of the Soviet Union on this question, and to show and prove, on the basis of the universally-accepted international definition of aggression, that the aggressor in the Korean question is the Govemment of the United States.
1shall confine myself today to this brief observation, reserving the right to make a more detailed statement in my capacity as representative of the Union of Soviet Socialist Republics on a number of the questions referred to by the United States representative.
As regards the United Kingdom representative's wish to make a full statement tomorrow on the question we are discussing, 1 consider that we should meet bis wish and give him this opportunity. We shall conclude today's meeting at this point, if no one else wishes to speak on this question.
Mr. ALVAREZ (Cuba.) (translated tram Spcmirh): My delegation had taken no part in tbis lengthy discussion on the agreemeiJlt a1ready reached by the Security Counci1 that the representative of the Republic of Korea should take a seat at the Counci1 table throughout the discussion of this item on the agenda, name1y, the complaint of aggression upon the Republic of Korea. We were waiting patiently for the President to fu1fi1 the duty incumbent upon him under rule 30 of the rules of procedure and make a ruling to settle the point of order which. has been repeatedly raised. The ruling which the President has actually made is that he will not comply with the rules of procedure or take any account of the decision reached by the Counci1 on 25 June. He says that he has taken no such decision, but it seems that in fact he has.

Mr. AUSTIN (United States of America): Before we adjourn, l should like to keep the record straight. A challenge has been made to the ruling of the President, and a vote on that challenge is due now, tOOay, at this moment. The President hàS ruled, by both ward and act, that the point of order raised by Mr. Tsiang, the representative of China, does not have priority. This is a violation of the law. The attempt to bring on for consideration other business is a deniaI in fact of the priority and a deniaI in fact of the right of the representative of the Republic of Korea to be present here while discussion of this subject goes on.
On this challenge, the parliamentary question is: ShaIl·the representative of the Republic of Korea take his seat? Those who are in favour of it, raise their bands; t\Iose who are against it, raise their hands; and those who want to abstain, raise their hands. That is what ought to take place right now.
During t!Je interpretation of his speech, Mr. Austin made the following correction: l want tomake a correction that should be stated. l should have stated "Those who are in favour of not seating the representative, mise their hands". l stated it iil the other fonn, as it was interpreted, but l want it to be corrected.
In the light of these considerations, the President declares that he gave no ruling, that he is not giving and is not in a position to give a ruling. That is the position. Whether or not that is agreeable to the United States representative is bis own affair. But the President eaDnot give a ru1ing. 1 have already said this on a number of occasions and 1 repeat it once again. As no one wishes to speak, and as the United Kïngdom representative has expressed: a desire to speak tomorrow, l'consider that, in view of the lateness of the hour, it would be advisable to conclude our work today at this point.
