S/PV.807 Security Council

The Council has berore it the draft resolution submitted by the delegations of Australia, Colombia, the Philippines, the United Kingdom and the United States of America [S/3911J. It is evident from the debate on this proposal that widely divergent views are held both by members of the Council and by the parties concerned regarding the contents of the draft resolution. 2. In an effort to meet the objections which have been raised, I have submitted certain amendments to the joint draft resolution in the hopethatsuch amend- ments might be of assistance in surmounting the difficulties with which we are faced. 3. These amendments, which are contained in docu- ment S/3920, are the following: (1) In the fourth paragraph of the preamble the words " commitments undertaken by them in " should be deleted and the following words inserted: "provi- sions of its resolution dated 17 January 1948 1 and of". Further, in the same paragraph, the words" in accordance with their terms" should be inserted between "envisage" and "the determination ". The paragraph would then read: 1. M. I have listened with the greatest interest to what the repre- sentative of Sweden has said about the amendments which he has put forward [8/8920], to the draft resolu- tion [SF~911] of which the United Kingdom is one of the sponsors. 5. All I would say at this moment is that I am very sensible of the helpful and constructive spirit in which Mr. Jarring has advanced this proposal and that I hope and believe that it will be regarded in that light by the two parties. The United Kingdom Government would certainly have a disposition to support any form of words acceptable to both parties. 6. As I said at the 797th meeting, our desire is to avoid any proposal which could give offence to either India or Pakistan or in any way impair the close relations with them to which we attach so much impor- tance. I have confidence in the statesmanship and wisdom of both India and Pakistan. If in fact this draft resolution, as amended in accordance with Mr. Jarring's proposal, is agreeable to the two parties, nothing could give the United Kingdom delegation greater satisfaction. If it were thought to open a perspective of greater hope along the road to a solution of the problem, nothing would please us more. It is in that spirit that we anxiously and hopefully await the reactions of the delegations of Pakistan and India to the proposal.

I wish to associate my delegation with the spirit as well as the letter of the remarks just made by the representative of the United Kingdom. 8. Comme je I'ai dit a la 797e seance, nous desirons eviter toute proposition qui pourrait offenser soit I'Inde soit le Pakistan ou compromettre d'une maniere quelconque, les liens etroits qui nous unissent aces deux pays et auxquels nous attachons une si grande importance. Jarring, est acceptable pour les deux parties, la delegation du Royaume-Uni sera parfaitement satis- faite. Si I'on pense que cette resolution permet de plus grands espoirs de trouver une solution au probleme, nous en serons tres heureux. C'est dans cet esprit que nous attendons avec impatience et espoir les reactions des delegations du Pakistan et de I'lnde. 7. M. WADSWORTH (Etats-Unis d'Amerique) [tra- duit de l'anglais] : Ma delegation tient a s'associer a l'esprit comme a la lettre des remarques que vient de formuler le representant du Royaume-Uni. 8. La delegation des Etats-Unis a, elle aussi, etudie avec une grande attention les modifications proposees par le representant de la Suede, et elle comprend 9. If the amendments proposed by Sweden could be helpful in bringing about some reconciliation of views and in making it possible for the United Nations Representative to undertake the mission envisaged, we would certainly give it the most serious and favour- able consideration.

The Philippine delega- tion wishes to commend the efforts of Mr. Jarring, the representative of Sweden, to bring about a recon- ciliation of the views of the parties interested in this matter of Kashmir. 11. The Philippine delegation would like to hold in abeyance its views on this question until after the two interested parties have made known their stand on the amendments presented by the representative of Sweden.

I should like to say a few words as one of the sponsors of the draft resolu- tion which is before the Council and to which amend- ments have now been tabled. The original text, so far as Australia and I am sure so far as the other sponsors are concerned, was put forward in the hope that it would advance the consideration by the Council of this difficult problem of Kashmir. and in the hope that the two parties, India and Pakistan, would be able to accept this resolution in the spirit in which it is being offered by the sponsors. 13. We have, of course, heard various objections to the draft resolution, and we now' have before us sug- gested amendments. I should like to say first of all that we have the greatest respect for the efforts of conciliation displayed in the past and on this occasion by the representative of Sweden. His long experience in the sub-continent and his previous mission on behalf of the Council certainly entitle him to bring forwa.rd the suggestions which he has advanced, in the same spirit I feel, as the sponsors had advanced their previous draft resolution. However, these proposed amendments, although they bear the date of 27 No- vember, I think were distributed only rather late yesterday. While we have examined them, we would like to be able to give them a little more consideration. 14. My initial feeling is that if they can receive the support and the approval of the parties, we probably would have little difficulty. But I should like to examine them a little further. I think other members of the Council might well feel that it would be appropriate not to rush into a vote on this matter but to adjourn cOJ.1sideration for just a short period - not a long adjournment necessarily by any means - but have 9. Cependant, ces amendements, bien qu'iIs soient dates du 27 novembre, n'ontetedistribues, il me semble, qu'hier, tard dans la journee. Nous les avons examines, mais nous aimerions pouvoir les etudier plus a fond. 14. Ma premiere impression est que, si ces propositions suedoises peuvent recueiIlir l'assentiment des parties, nous ne rencontrerons guere de difficultes. J'aimerais cependant les examiner d'une maniere un peu plus approfondie. Je crois que d'autres membres du Conseil pensent egalement qu'iI conviendrait de ne pas preci- piter le vote, et qu'il serait preferable d'ajourner l'examen de la question, non pas necessairement pour

As suggested by the representative of Australia, we should like a short time to consider the amendments. 17. Mr. Krishna MENON (India): We saw these amendments yesterday and we would like to endorse the thoughts expressed in the Council in regard to the purpose of the efforts of Mr. Jarring. We have telegraphed the texts to the Government of India. I have no instructions in regard to them. In any case, we would have to communicate to the Government of kdia the views of the sponsor before we expressed ourselves any more on this subject. All that we would like to say on this matter at this meeting - a gret deal has already been said - is that whetever be the fate of these amendments, whatever our attitude be, we appreciate the spirit in which the representative of Sweden has presented them.

The Council has heard a suggestion to the effect that we should adjourn the consideration of the question for a short time. I invite comment on this suggestion regarding the time of the next meeting of the Council.

With regard to the date of the next meeting of the Security Council, as far as I know, there is a fairly heavy schedule of meetings for tomorrow. There is a plenary meeting of the General Assembly and meetings of the First Committee are planned. I would therefore ask the Council to meet again not tomorrow, but on Monday, 2 December, if possible.

I would like to second the proposal of the representative of the Soviet Union to have the next meeting scheduled not for tomorrow, but possibly for Monday afternoon. .21. Mr. WALKER (Australia): So far as the Australian delegation is concerned, Mr. President, we would be very happy to leave the matter in your hands, taking into account the rather heavy programme we have ahead of us. But the programme sometimes changes. If other members of the Council and the parties are in a position to take up the matter earlier and if the programme permits, then of course we have full con- fidence in your discretion to call a meeting of the Council whenever it is convenient. We will be ready ·to consider the matter at any time. 15. Pour autant que je sache, le programme de demain est tres chargee : on prevoit une seance pleniere de l'Assemblee generale, en meme temps que des seances de la Premiere Commission. Je voudrais done demander que la prochaine seance du Conseil soit fixee, si possible, au lundi 2 decembre, et non a demain. 20. M.
