Before we start our work, I should like to convey to the representative of Japan our appreciation of th~ dignified manner with which he presided over the proceedings of the Security Council during the month of October, This is no mere casual remark. Amba:;- sador Matsudaira, as the distingui$hed representative of an age~old culture, contributed his great ability to the work of this Council and did honour to a great diplomatic tradition. 1. Since this is the first time that my country occupies the presidency of the Security Council, I should like to make a brief statement before we examine the agenda of today's meeting. 3. I shall refer first. to tile question of disarmament in so far as it CDmes within the jurisdiction of the Secu~ rity Coumil and the Military Staff C(Jmmitt~e. 6, The resolution recently adopted by the General Assembly to establish 11 Disarmament Commission composed of the eighty-one Member States [resolution 1252 D (XIIl)} makes it necessary (or the members of the Council and for the S~cretary-Generalto consider methods of co-ordinating tile work of the Disarmament Commission with the functions conferred by the Cllurter upon the Security Council and the Military Staff Committee. 7. It is t:ue that under Article 11 of the Charter tiIe Assembly may make recommendations to the Members or tn the Sec11l'ity Council or lo both ""ith regurd to the principles governing disarmament and the regulation of armaments, hut that authority does not mean that the Security Cottncil rmd the iVlililary Staff Committee call abdicl:!le tile functions specitically conferred upon tl\.em by Articles 26 and 47 of the Charter for formulating plans relating to the reglllatioll of armaments and possible disarmament. 8. There must he new intellectual processes that will bring bto being a new and creative mental attitude so that we may seek and find solutions in keeping with Lhe realities of om thll~. 9. Houtine procedures no longer suffice to solve the gigantic difficulties in the way of maintaining interna~ tional peace and secudty. Modern internat;oual law demands a new dynamics w:lich will er..able the international commuIlity to define its aims from time to time, for those aims must he kept in proportion \:'0 tlle needs of MemhCr States and to the resources availahle for tlle solution of current problems. 10. TOWards that end, the United Nations Chart~r, in paragraph 2 of Article 28, provides the possibility .for periodic meetings of the Security Council, the obvious jmrpose being that the activities 01 the Council should go beyond fle me~e peaceful settlement of disputes and action with respect to tl.1reats to the peace, breaches of the peace, nnd acts of aggression. 5. Not only did he have a brillbot poli- tical career as a Mb.ister of El Salvador ]lOlding the portfolio:' of Education, JusLice alld Foreign Relations, but his international career had the climensions of real greatness. In his ~xercise of the lLighest o!TIces in the international community, Dr. Guerrero combined wisdom with uprightness, and great knowledge with justice. Thus he won a p:ace of honour in the hisLory of his counLry, of America and of the world. 'TIle PRESIDENT (translated from Spanish): We meet in accordance with Alticle 14 of the Statute of the International Court of Justice, so that the Council may fix the date of the election to fill the vacancy on the International Court resulting Irom the death of Judge Guerrero. 18. Following the practice established in such cases, I am submitting for your consideration a draft reso M lution under which the election to fill the vacancy would take pillee during the fourteenth session of the General Assembly or any special session which might be held before the fourteenth session, 19. The draft resolution has been distributed to members of the Council. Before opening the discussion on it, I should like to malte a clarification, When the operative part of the draft resolution says that tlte election to flU the vacancy shall take pl£lce during the fourteenth session or during a special session, it refers to the special sessions for which provision is made in paragraph (a) of rule 8 of the rules <If procedure of the General Assembly. I m1\ke this explanation in order to prevent any confusion. The term special session cannot in any case be made to cover an emergency session; it means only a special session coming under paragraph (a) of rule 8 of the rules of procedure, 20. Moreover, for the infonnation of members, I should like to say that the Secretary-General addressed a letter on 14 November to the members of the Per- manent Court of Arbitration and to the natiotlal groups which are authorized to submit nominations of candidates to fill vacancies informing them that they had three months to submit those nominations; thus, all the provisions of Articles 5 and 14 of the Stahtte of the International Court of Justice have been duly taken into account. 21. lE there is no objection, I shall consider that this draft resolution is adopted. In his letter of 16 November, the Minister of Foreign Affairs of Lebanon has reques.ted the Council to delete from the list of matters of whicll it is seized the Lebanese complaint submitted to it on 22 May 1958 [SI4007]. The Lebanese Government has further requested the Council to ask the Secretary-Gelleral to communicate its decision to the General Assembly. 23. In its fifth report, dated 14 November, the United Nations Observation Group in Lebanon states as a conclusion that, since the task assigned to it may be regarded as completed, the withdrawal of the United Nations Observation Group in Lebanon should now be undertaken. The Secretary-General, in a letter dated 17 November, has infonned the members of the Council of the measures heillg taken for the liquidation of that operation. 25. In view of these circumstances, I have consulted with be members of the Council and all appear to agree to making those decisions. Consequently, if there is no objection, I shall place on record that the Council has agreed to delete from the list of matters of which it is seized the complaint submitted by the Lebanese Governmeut on 22 May 19~8, on the understanding Ulat the Secretary-General shall communicate that decision to the General Assembly in accordance witlt the mandate conferred upon him in the n~sQhttion of 21 August 1958 [restJlulion 1237 (ES~J[I)]. 26.
