RESOLUTION ADOPTED ON THE REPORT OF THE
SIXTH COMMITTEE
RESOLUTION ADOPTEE SUR LE RAPPORT DE LA
SIXIEME COMMISSION
285 (III). Violation by the Union of
Soviet Socialist Republics of funda-
mental human rights, traditional
diplomatic
practices and
other
principles of the Charter
The General Assembly,
Co111sidering the item proposed by Chile on
"violation by the Union of Soviet Socialist Re-
publics of fundamental human rights, traditional
diplomatic practices and other principles of the
Charter", which violation has consisted in pre-
venting the Soviet wives of citizens of other
nationalities from leaving their country with their
husbands or in order to join them abroad, even
when they are married to persons belonging to
foreign diplomatic missions, or to members of
their families or retinue,
Considering that in the preamble to the Charter
of the United Nations all the signatory countries
resolved "to re-affirm faith in fundamental human
rights, in the dignity and worth of the human
person,
in
the
equal
rights
of
men
and
women ... ",
Considering that Article 1 ( 3) of the Charter
binds all Members to encourage "respect for
human rights and for fundamental freedoms for
all without distinction as to race, sex, language
or religion", and that in Article SS c of the
Charter the Members undertook to promote "uni-
versal respect for, and observance of, human
rights and fundamental freedoms for all without
distinction as to race, sex, language, or religion",
Considering, lastly, that the Economic and
Social Council, in pursuance of the powers con-
ferred upon it by Article 62 (2) of the Charter,
in its resolution 154 (VII) D dated 23 August
1948, deplored the '·.~gislative or administrative
provisions whii:\ deny to a woman the right to
leave her country of origin and reside with her
husband in any other" and that the Universal
Declaration of Human Rights formulated by the
United Nations General Assembly, in its articles
13 and 16, provides that everyone has the right
to leave any country including his own and that
men and women of full age have th<' right to
marry without any limitation due to race, nation-
ality or religion,
Declares that the measures which prevent or
coerce the wives of citizens of other nationalities
from leaving their country of origin with their
husbands or in order to join them abroad, are

C onsiderant le point propose par le Chi Ii sur
la "violation par l'Union des Republiques socia-
listes sovietiques des droits fondamentaux de
l'homme, des usages diplomatiques traditionnels
et des principes de la Charte' , violation qui a
consiste a empecher que des femmes de natio-
nalite sovietique, mariees a des ressortissants
d'une nationalite differente, quittent leur pays en
compagnie de Ieur mai:i uu pour rejoindre leur
mari a l'etranger, meme lorsqu'elles sont mariees
a des personnes appartenant a des missions diplo-
matiques ou a des membres de leur famille ou de
leur suite,
Considerant que, clans le preambule de la
Charte des Nations Unies, tons les pays signa-
taires ont entendu "proclamer a nouveau [leur]
foi clans Jes droits fondamentaux de l'homme,
clans la <lignite et la valeur de la personne hu-
maine, clans l'egalite de droit des hommes et des
femmes ... ",
Considerant que l'Article 1, 3) de la Charte
oblige tons Jes Etats Membres a encourager "le
respect des droits de l'homme et des libertes fon-
damentales pour tous sans distinction de race, de
sexe, de langue ou de religion" et que par l'Ar-
ticle SS c de la Charle, les Etats Membres se
sont engages a favoriser "le respect universe! et
effectif des droits de l'homme et des libertes fon-
damentales pour tons, sans distinction de race,
de sexe, de langue ou de religion",
C onsiderant enfin que, clans sa resolution 154
(VII) D du 23 aout 1948, le Conseil econo-
mique et social, en vertu des attributions que Jui
confere l'Article 62, 2) de la Charte, condamne
"les dispositions legislatives ou administratives
qui <lenient a la femme le droit de quitter son
pays d'origine et de resider avec son mari dans
tout autre pays" et que la Declaration universelle
des droits de l'hommc formulee par l'Assemblee
generale des Nations Unics prevoit, dans ses arti-
cles 13 et 16, que toute personne a le droit de
quitter tout pays y compris le sien et que J'homme
et la frmme d'age nubile ont le droit de se marier,
sans aucunc restriction quant a la race, la natio-
nalite OU la religion,
Declare que les mesures qui empechent Jes
epouses de ressortissants d'une nationalite diffe-
rcnte de quitter leur pays en compagnie de leur
man Ott pour rejoindre leur mari a J'etranger,

not in conformity with the Charter; and that
when those measures refer to the wives of per-
sons belonging to foreign diplomatic missions, or
of members of their families or retinue, they are
contrary to courtesy, to diplomatic practices and
to the principle of reciprocity, and are likely to
impair friendly .relations among nations;
Recommends the Government of the Union of
Soviet Socialist Republics to withdraw the
measures of such a nature which have been
adopted.

et aux usages diplomatiques ainsi qu'au principe
de reciprocite, et sont de nature a compromettre
Jes relations amicales entre nations;
Recommande au Gouvernement de !'Union des
Republiques socialistes sovietiques de rapporter
Jes mesures de cette nature qui ont ete prises par
lui.
