4. To include this lllatter in the agenda of the second regular session of the General Assembly. Fifty-fifth plenary meeting, 11 December I.946. 39 (I). Relations of Members of the United Nations with Spain The peoples of the United Nations, at San Francisco, Potsdam and London, condemned the Franco regime in Spain and decided that, as long as that regime remains, Spain may not be admitted to the United Nations. The General Assembly, in its resolution of 9 February 1946, recommended that the Members of the United Nations should act in accordance with the letter and the spirit of the declarations of San Francisco and Potsdam. The peoples of the United Nations assure the Spanish people of their enduring sympathy and of the cordial welcome awaiting them when cir- cumstances enable them to be admitted to the United Nations. The General Assembly recalls that, in May and June 1946, the Security Council conducted an in- vestigation of the possible further action to be taken by the United Nations. The Sub-Committee of the Security Council charged with the investigation found unanimously: 1 " (a) In origin, nature, structure and general conduct, the Franco regime is a fascist regime patterned on, and established largely as a result of aid received from, Hitler's Nazi Germany and Mussolini's Fascist Italy. "(b) During the long struggle of the United Nations against Hitler and Mussolini, Franco, despite continued Allied protests, gave very substantial aid to the enemy Powers. First, for example, from 1941 to 1945, the Blue Infantry Division, the Spanish Legion of Volunteers and the Salvador Air Squadron fought against Soviet Russia on the Eastern front. Second, in the sum- mer of 1940, Spain seized Tangier in breach of international statute, and as a result of Spain maintaining a large army in Spanish Morocco large numbers of Allied troops were immobil- ized in North Africa. " (c) Incontrovertible documentary evidence establishes that Franco was a guilty party with Hitler and Mussolini in the conspiracy to wage war against those countries which eventually in the course of the world war became banded together as the United Nations. It was part of the conspiracy that Franco's full belligerency should be postponed until a time to be mutu- ally agreed upon." L'Assemblee generale rappelle qu'en mai et juin 1946, le Conseil de securite a procede a une etude des mesures que les Nations Unies pourraient prendre ulterieurement a cet egard. Le Sous-Comite du Conseil de securite charge de cette etude a conclu unanimement: 1 "a) Par son origine, sa nature, sa structure et son comportement general, le regime fran- quiste est un regime fasciste calque sur I' Alle- magne nazie de Hitler et l'Italie fasciste de Mussolini et institue en grande partie grace a leur aide. "b) Au cours de la l uue prolongee menee par les Nations Unies contre Hitler et Mussolini, Franc0, en depit des protestations reiterees des Allies, a fourni unc aide tres importante aux Puissances ennemies. Tout d'abord, par exemple, de 1941 a 1945, la Division bleue d"in- fanterie, la Legion espagnole des volontaires et !'Escadrille Salvadore ont combattu contre la Russie sovietique sur le front de !'Europe orientale. En second lieu, en ete 1940, l'Espagne a pris Tanger en violation du statut international de cette ville et, du fait qu'elle entretenait une armee dans le Maroc espagnol, elle immobilisait des effectifs considerables de troupes alliees en Afrique du Nord. Spanish people with the aid of the Axis Powers :md which gave material assistance to the Axis Powers in the war, does not represent the Spanish people, and by its continued control of Spain is making impossible the participation of the Span- ish people with the peoples of the United Nations in international affairs; Recommends that the Franco Government of Spain be debarred from membership in interna- tional agencies established by or brought into relationship with the United Nations, and from participation in conferences or other activities which may be arranged by the United Nations or by these agencies, until a new and acceptable government is formed in Spain. The General Assembly, Further, desiring to secure the participation of all peace-loving peoples, including the people of Spain, in the community 0£ nations, Recommends that if, within a reasonable time, there is not established a government which de- rives its authority from the consent of the gov- erned, committed to respect freedom of speech, religion and assembly and to the prompt holding of an election in which the Spanish people, free lrom force and intimidation and regardless of party, may express their will, the Security Council consider the adequate measures to be taken in order to remedy the situation; Recommends that all Members of the United Nations immediately recall from Madrid their Ambassadors and Ministers plenipotentiary accredited there. The General Assembly further recommends that the States Members of the Organization re- port to the Secretary-General and to the next session of the Assembly what action they have taken in accordance with this recommendation. Voting Procedure in the Security Council The G~neral Assembly, Mindful of the Purposes and Principles of the Charter of the United Nations, and having taken notice of the divergencies which have arisen in regard to the application and interpretation of Article 27 of the Charter: Earnestly requests the permanent members of the Security Council to make every effort, in con- sultation with one another and with fellow mem- bers of the Security Council, to ensure that the use of the special voting privilege of its perma- nent members does n.ot impede the Security Council in reaching decisions promptly; Recommends to the Security Council the early adoption of practices and procedures, consistent with the Charter, to assist in reducing the diffi- culties in the application of Article 27 and to ensure the prompt and effective exercise by the Security Council of its functions; and 64 au peuple espagnol, avec l'appui des Puissances de l'Axe, et qui a fourni une aide materielle aux Puissances de l'Axe dans la guerre, ne represente pas le peuple espagnol et rend impossible, tant qu'il restera au pouvoir en Espagne, la participa- tion du peuple espagnol aux affaires interna- tionales avec les autres peuples des Nations U nies; Recommande que l'on empeche le Gouverne- ment espagnol franquiste d'adherer a des insti- tutions interf.ationales etablies par les Nations Unies ou relie~ a !'Organisation et de participer aux conferences ou autres activites qui peuvent etre organisees par les Nations Unies ou par les institutions precitecs, jusqu':1 la formation, en Espagne, d'un gouvernement nouveau et ac- ceptable. L' Assemblee generate, Desirant, en outre, que tous Jes peuples paci- fiques, y compris le peuple espagnol, participent a la communaute des nations, Recommande que, si, dans un delai raisonna- ble, il n'est pas etabli un gouvernement tenant son autorite du consentement des citoyens, qui s'en- gage a respecter la liberte de parole, de culte et de reunion, et a organiser sans delai des elections par lesquelles le peuple espagnol, libere de toute con- trainte ou intimidation, et sans consideration de partis, puisse exprimer sa volonte, le Conseil de securite etudie les mesures adequates a prendre pour remedier a cette situation; Recommande, des maintenant, a tous les Membres des Nations Unies de rappeler de Ma- drid les ambassadeurs et ministres plenipoten- tiaires qu'ils y ont accredites. L'Assemblee generate recommande en outre aux Etats Membrcs de faire rapport au Secre- taire general et a la prochaine Assemblee sur Jes mesures qu'ils auront prises en execution de la presente recommandation. Procedure de vote au ConseU de securite L'Assemblee generate, Respectueuse des Buts et Principes de la Charte des Nations Unies, et ayant pris connaissance des divergences qui se sont elevees en ce qui concerne l'application et l'interpretation de l'Article 27 de la Charte: Demande instamment aux membres perma- nents du Conseil de securite de s'efforcer, par des consultations entre eux et avec les autres mem- bres du Conseil de securite, de faire en sorte que l'exercice du privilege du veto qui appartient en propre aux membres permanents n'empeche pas le Conseil de securite de prendre des decisions rapides; Recommande au Conseil de securite d'adoptei sans delai des methodes et des procedures con- formes a la Charte, qui permettent de faciliter !'application de l'Article 27 et qui garantissent le fonctionnement rapide et efficace du Conseil; et
