The Security Council,
Recalling its relevant resolutions on the ongoing cooperation between Iraq and
Kuwait on the return of Kuwaiti property and the National Archives, and the
repatriation or return of all Kuwaiti and third-country nationals or their remains
(“missing persons and property”), in particular recalling resolutions 2107 (2013) and
2732 (2024), and underlining the humanitarian nature of these efforts,
Recalling its intention to review the modalities of the reporting on the missing
persons and property as set out in operative paragraph 4 of resolution 2107 (2013),
Recalling its request of the Secretary-General to make recommendations to the
Council for an appropriate follow-on mechanism by 31 May 2025 to support
continued progress should the return of the missing persons and property not be
resolved upon termination of UNAMI’s mandate on 31 December 2025,
Underlining the humanitarian importance of allowing families to know the fate
and whereabouts of their missing relatives, consistent with applicable international
humanitarian law and relevant resolutions on the protection of civilians in armed
conflict, including resolution 2474 (2019),
Recognizing Iraq’s contribution to regional security and prosperity and
welcoming and encouraging Iraq’s continued demonstration of its commitment to
fulfilling its obligations in the search for missing Kuwaiti and third -country nationals
within the framework of the Tripartite Commission and its Technical Subcommittee
under the auspices of the International Committee of the Red Cross (ICRC),
Welcoming the commitment of Iraq to post-conflict reconciliation, recognizing
Iraq and Kuwait’s expertise in the field of missing persons and underscoring the
valuable international contribution Iraq and Kuwait can both play in sharing this
expertise and experience in other post-conflict contexts, in a manner that aligns with
the spirit of Security Council resolution 2474 (2019), which encourages the exchange
of best practices and the strengthening of cooperation in addressing the humanitarian
dimensions of this issue,
Noting Option (a) of the Secretary-General’s recommendations (as contained in
document S/2025/320) pursuant to Security Council Resolution 2732 (2024) that the
Security Council may request the appointment of a Senior Representative as an

appropriate follow-on mechanism to promote, support, and facilitate efforts regarding
the repatriation or return of Kuwaiti missing persons and property,
Highlighting the great scientific and technological progress which has
significantly increased the efficacy of the search for and identification of missing
persons and encouraging Member States, particularly those with relevant information
or technical capabilities, to provide assistance to the Senior Representative and the
concerned parties including through providing access and additional funding and
training for, inter alia, forensic sciences, DNA analysis, satellite maps and imagery,
and ground penetrating radar, and welcoming, in this regard, capacity-building on
innovative technologies and the sharing of lessons learned, for example the training
workshop for technical experts and decision makers from Iraq and Kuwait, conducted
in Nicosia by the Committee on Missing Persons in Cyprus (CMP) in 2024,
1. Requests the Secretary-General to appoint a Senior Representative whose
mandate will solely focus on promoting, supporting and facilitating efforts regarding
the repatriation or return of all Kuwaiti and third -country nationals or their remains,
and the return of Kuwaiti property, including the national archives;
2. Requests the Secretary-General to keep the Security Council informed of
progress by 31 March 2026, and every six months thereafter, and to suggest, as
appropriate, in such updates his assessment of what could be conducive to
encouraging further progress, and to make available his good offices to strengthen
confidence and mutual trust between Iraq and Kuwait on missing persons and
property;
3. Encourages continued efforts, with the support of the Senior
Representative and the International Committee of the Red Cross, on this matter,
including through excavation of all sites of interest and making use of technology
advances and UN support;
4. Underlines that the Security Council will consider the continued need for
United Nations oversight on missing persons and property not later than 31 December
2030, or sooner in the event of sufficient progress, and in that regard, expresses its
intention to review the situation no later than 30 June 2028 on the basis of the good
faith efforts made by all stakeholders and the Secretary-General’s assessment of
progress and determination to resolve this issue, and notes in this regard that if the
fates of all the missing Kuwaiti and third-country nationals have not been determined
by 31 December 2030, Iraq commits to continue to address the search for any
remaining missing Kuwaiti and third-country nationals through all appropriate
channels.
