Treatment of people of Indian and lndo-Pakistan origin in the Union of South Africa The General Assembly, Recalling its resolution 1460 (XIV) of 10 December 1959, Having considered the reports of the Governments of India1 and Pakistan,2 1. Notes that the Governments of India and Pakistan have reiterated their readiness to enter into negotiations with the Government of the Union of South Africa in accordance with the expressed desires of the United Nations, and with the express declaration that such negotiations would not in any way prejudice their own position or the position taken by the Government of the Union of South Africa regarding their respective jurid- ical stands in the dispute ; 2. Notes with deep regret that the Government of the Union of South Africa has not replied to the communi- cations from the Governments of India and Pakistan on this subject, and has not yet shown any disposition to arrive at a solution of this problem in accordance with the purposes and principles of the Charter of the Unitecl Nations, the Universal Declaration of Human Rights and the rep<';,.ted recommendations of the General As- sembly; 3. Draws the attention of the Government of the Union of South Africa to the repeated appeals of the General Assembly to co-operate to this end; 4. Urges the Government of the Union of South Africa to enter into negotiations with the Governments of India and Pakistan; 5. Invites Member States to use their good offices in such manner as may be appropriate to bring about the negotiations envisaged by the General Assembly in this matter; 6. Question of race conflict in South Africa resulting from the policies of apart- heid of the Government of the Union of South Africa The General Assembl}', Recalling its previous resolutions on the question of race conflict in South Africa resulting from the policies of apartheid of the Government of the Union of South Africa, Considering that its resolutions 6 ll, 1l ( V 11 ) of 5 December 1952, 917 (X) of 6 December Jt)55 and 1248 (XIII) of 30 October 1958 have declared that racial policies designed to perpetuate or incn·ase di;-;crimina- tion are inconsistent with the Charter llf the L: nited Nations and with the pledges of ~!embers Ullder Article 56 of the Charter, Noting that its resolutions 395 ( V) of 2 December 19 50, 511 ( \" I ) of 12 January 19 5 2 a 11 d (, ]() . \ ( \ 1 I ) of 5 December 1952 have successively affirmed that the policy of racial segregation (apartheid) is lll'L'l"ssarily based on doctrines of racial discrimination, Rcrnlling also that the c;overnment of the Union of South Af. ica has failed to comply with the repeated requests and demands of the United Nations and world public opinion and to reconsider or revise its racial policies or to observe its obligations under the Charter, 1. Deplores such continued and total disregard hy the Covernrnent of the Union of South Africa and fur- thennore its fietermined aggravation of racial issues by more discriminaton· laws and measures and their en- forcement, accompa;1ied by violence and bloodshed; 2. Deprecates policies based on racial discrimination as reprehensible and repugnant to human dignity; 3. Requests all State,; to consider taking such sepa- rate and collective action as is open to them, in con- formity with the Charter of the United Nations, to bring about the abandonment of these policies; 4. Affirms that the racial policies being pursued by the Government of the Union of South :\ frica are a flagrant violation of the Charter of the United Nations and the Universal Declaration of Human Rights and are inconsi5tent with the obligations of a Member State; 6 _ ,--~ __ G~ner~l Assembly - Fifteenth Ses_si_o_n ___ _ _ 5. Notes with grave concern that these policies have led to international friction and that their continuance endangers international peace and security ; 6. Reminds the Government of the Union of South Africa of the requirement in Article 2, paragraph 2, of the Charter that all Members shall fulfil in good faith the obligations assumed by them under the Charter; 7. Report of the Director of the United Nations Relief and Works Agency for Pales- tine Refugees in the Near East The General Assembly, Recalling its resolutions 194 (III) of 11 December 1948, 302 (IV) of 8 December 1949, 393 (V) of 2 December 1950, 513 (VI) of 26 January 1952, 614 (VII) of 6 November 1952, 720 (VIII) of 27 Novem- ber 1953, 818 (IX) of 4 December 1954, 916 (X) of 3 December 1955, 1018 (XI) of 28 Februarv 1957 1191 (XII) of 12 December 1957, 1315 (XIII) of 12 December 1958 and 1456 (XIV) of 9 December 1959, Noting the annual report of the Director of the United Nati~ns Relief and Works Agency for Palestine Refu- gees m the Near East, covering the period 1 July 1959- 30 June 1960,3 • Ibid., Fifteenth Session, Supplement No. 14 (A/4478). Noting with deep regret that repatnat10n or com- pensation of the refugees as provided for in paragraph 11 of General Assembly resolution 194 (Ill) has not been effected, that no substantial progress has been made in the programme endorsed in paragraph 2 of resolution 513 ( _YI_) for the reintegration of refugees either by repatnat10n 01· resettlement and that, therefore, the situ- ation of the reiugees continues to he a matter of serious concern, 1. Notes with regret that the United Nations Con- ciliation Commission for Palestine has not yet been able to report progress on carrying out the task entrusted to it in paragraph 4 of General Assembly resolution 1456 (XIV), and again requests the Commission to make efforts to secure the implementation of paragraph 11 of Assembly resolution 194 (III) and report thereon not later than 15 October 1961 ; . 2. Directs a'.tention ~o the precarious financial posi- tion of the Umted ;-Jat1ons Relief and \,Yorks Agency for Palestine Refugees in the Near East and urges Governments to consider to what extent they can con- tribute or increa~e their contributions so that the Agency can carry out its programmes; 3. Expresses its thanlcs to the Director and the staff of the Agency for their continued faithful efforts to ~arry out t~e mandate of the Agency, and to the special- 1ze~l agencies and the many private organizations for their valuable and continuing work in assisting the refugees. 993rd plenary meeting, 21 April 1961.
