I am happy to be able to inform the Assentlly that, in conformity with the directions of the President of the General Assembly, the Special Political Conunittee, which conducted its deliberations in a cordial atmosphere, was able to conclude its work within the scheduled time-frame. The first report (A/4l/730) relates to item 70 of the agenda, entitled "Effects of atomiC) radiation". The Speciai Political Committee considered this item at two meetings and, after hearing 24 statements in the general debate, adopted two draft resolutions without a vote. The draft resolutions, which appear in paragraph 13 of the report, are recommended to the General Assenbly for adoption. The second report (A/41/7S0) which I have ~.he hooour to present today relates to agenda item 71, "~port of the Special Committee to Investigate Israeli Practices Affecting the Human Rights of the Population of the O::cupied Territories". Six meetings of the Special Political Committee were devoted to this i tern and 39 delegations took part in the discussion. Seven draft resolutions, all of Which were adopted by recorded votes, appear in paragraph 26 of the report and are reoonmended to the General Assembly for its approval. The third report (A/4l/751) relates to items 72 and 137 of the agenda, entitled "International co-oper'tion in the peaceful uses of outer space" and "Question of the review of the Convention on 9)gistration of (])jects Launched into Outer Space". The Special Political Commi ttee devoted six meetings to consideration of these items and, after hearing 41 speakers in the general debate, adopted without a vote the draft resolutions which appear in paragraph ".2 of the report. I recommend those draft resolutions to the General ASSEmbly for its approval. The next report (A/41/752) relates to item 73 of the agenda, entitled "Canprehensive review of the whole question of peace-keeping operations in all their aspects". The Committee considered this item at three meetings and heard 25 statements in the general debate. The draft resolutioo, which was adopted without (Mr. Ahmed Khan, Rapporteur, Special Poli ti tea1 Commit tee) a vote, appears in paragraph 6 of th'! report and is recommended to the General AsSembly for adoption. Turning to agenda i tern 74, "Questions relating to information", the COI'IInittee's report is in document A/4l/753. Eight meetings were devoted to its considerattcm and 57 speakers participated in the general debate. The draft resolutions, three of ~ich were adopted by recorded votes, appear in paragraph 23 of the report and are reooumencled to the General Assemly for adoption. With respect to !19enda item 75, entitled "thited Nations Relief and WorkS Agency for Palestine Refugees in the Near East", the report of the COlllnittee is in document A/4l/754. The Special Poli tical Committee considered this i tern at seven meetings and heard 38 statements in the general debate. Eleven draft resolutions, whictl appear in paragraph 34 of the report, are recommended to the General Assenbly for adoption. '1\10 of the draft resolutions were adopted without a vote, and the rest by recorded votes. The report of the Special Political Committee on agenda item 76, "International co-operation to avert new flows of refugees", is in document A/4l/755. Three meetings of the Special Political Committee were devoted to this item and 27 delegations took part in the discussion. The draft resoll-t!on, which was adopted by consensus, appears in paragraph 13 of the report and is reoollll1ended to the General AssenOly for adoption. Wi th respect to agenda item 17, "Question of the Malagasy Islands of Glorieuses, Juan de Nova, Europa and Bassas da India", the Committee's report is in document A/4l/756. For the reason set out in paragraph 3 of the report, the special Poli tical Commit-tee recommends that the General Assenbly should include the item in the provis iooal agenda of its for ty-seoond sessia'l. (Mr. Ahmed lQum, Rapporteur, Special Political Committee) Lastly, I present the Ccmmittee's rePOrt (A/41/?S?) on agenda item 78, "Question of the composition of the relevant organs of the .United Nations". For the reason set out in paragraph 3 of the report, the Special Political Committee: recoll!!ecds that the General Assembly should include this item in the provisional agendac. of its forty-secCXld session. If there is no proposal under rule 66 of the rules of
procedure, I shall take it that the General Assembly decides not to discuss the
reports of the Special Political Committee.
It was so decided.
Statements will therefore be limited to explanations of
vote. The positions of delegations regarding the various recommendations of the
Special Political Committee have been made clear in the Committee and are reflected
in the relevant official records.
May I remind members that, in paragraph 7 of its decision 34/401, the General
Assembly decided that, when the same draft resolution is considered in a main
Committee and in plenary meeting, a delegation should, as far as possible, explain
its vote only once, that is, either in the Committee or in plenary meeting, unless
that delegation's vote in plenary meeting is different fzom its vote in the
Committee.
May I also remind members that, also in accordance with decision 34/401,
explanations of vote are limited to 10 minutes and should be made by delegations
from their seats.
I invite Members to turn their attention to the reports of the Special
Political Committee.

The first of these is agenda item 121, concerning the ·Observer status of national liberation movements recognized by the Organization of African Unity and/or the League of Arab States". The relevant report of the Sixth Committee is found in document A/4l/886. The draft resolution which the Sixth Committee recommends to the Assembly for adoption is to be found in paragraph 8 of the report and was adopted by the Sixth Committee in a recorded vote by 93 votes in favour, 9 against and 16 abstentions. In accordance with the terms of the draft resolution, the General Assembly would, among other things, urge all States that have not done so, in particular those which are hosts to international organizations or to conferences convened by, or held under the auspices of, international organizations of a universal character, to consider as soon as possible the questicn of ratifying, or acceding to, the Vienna convention on the Representation of States in their Relations with International Organizations of a Universal Character. The General Assembly would also call once more upon the States concerned to accord to the delegations of national liberation movements recognized by the Organization of African Unity and/or by the League of Arab states and accorded observer status by international organizations, the facilities, privileges and immunities necessary for the performance of their functions in accordance with the provisions of the Convention. (Mr. Castroviejo, Rapporteur, Sixth Committee) I shall now re fer to item 122 of the agenda, enti tied "Sta tus of the Protocols Additional to the Geneva Conventions of 1949 and relating to the protection of victims of armed conflicts". The report of the Sixth Committee (A/4l/887) is in document A/4l/887. Under the draft resolution in paragraph 7 of the report, the General Assenbly, amoog other things, would request the secretary-General to submit to the General Assembly at its forty-third session a report on the status of the Protocols based on information received from Menber States. The Sixth Committee adopted this draft resolution without a vote and I hope that the General Aeeembly will be able to do the same. The report of the Sixth Committee on item 123 of the agenda, entitled "Progress ive development of the pr inei pIes and norms of interna tional law rela ting to the new international economic order", is in document A/4l/888. The draft resolution recommended by the Sixth Committee for adoption by the General Assenbly, in paragraph 10 of the report, was adopted by the sixth Committee by a recorded vote of 93 votes to none, with 21 abstentions. The draft resolution, among other things, requests the secretary-General to seek proposals of r.1ember States coocerning the most appropriate procedures to be adopted with regard to the consideration within the Sixth Committee of the analytical study prepared by the united Nations Insitute for Training and Research (UNITAR), as well as the forum to be entrusted with the work of the codification and progressive developnent of the principles and norms of international law relating to the new international economic order. Those p:oposals would be included in a report to be presented to the next session. The draft resolution also recommends that consideration of the most appropr iate procedures for completing tile preparation of the process of codification and progressive development of the principles and norms of (Mr. Cas troviejo , Rapporteur, Sixth Commi t tee) international law and of the forum that would be entrusted with the task be begun at that session with a view to making a final decision after taking into account the proposals and suggestions made by Member States on the matter. I now turn to document A/4l/889, which contains the report of the Sixth Committee on item 124, entitled "Peaceful settlement of disputes between States". The draft resolution recommended to the General Assembly for adoption, which the Sixth Commitee adopted by a recorded vote of 107 to none, with 7 abstentions, is to be found in paragraph 17 of the document. According to the terms of that draft resolution, the General Assembly, among other things, would request the Special Committee on the Charter of the United Nations and on the Strengthening of the Role of the Organization, at its next session, to continue its work on the question of the peaceful settlement of disputes between States and, in this context, to continue the consideration of the working paper on the resort to a commission of good offices, mediation or conciliation with the United Nations aiming at submitting conclusions thereon to the General Assembly at the earliest possible date, and to examine the progress report of the Secretary-General on the elaboration of the draft handbook on the peaceful settlement of disputes between States. The ~eport of the Sixth Committee on item 125 of the agenda, concerning the draft code of offences against the peace and security of mankind, is in document A/41/890. The draft resolution recommended to the General Assembly for adoption is in paragraph 8 of the report. It was adopted by a recorded vote of 102 to 5, with 7 abstentions. In accordance with the draft resolution the General Assembly, among other things, would invite the International Law Commission to continue its work on the elaboration of the draft code of offences against the peace and security of (Mr. Castroviejo, Rapporteur, Sixth COmmittee) mankind by elaborating an introduction and a list of the offences, taking into account the progress made at its thirty-eighth session as well as the views expressed at the forty-first session of the General AsseJTbly. Next I should like to draw the attention of the members of the General Assell'bly to the report of the Sixth Committee (A/4l/860) on item 126 of the agenda, concerning the report of the Special Conunittee on Enhancing the Effectiveness of the Principle of Non-Use of Force in International Relations. The draft resolution which the Sixth Committee recommends to the General Assembly is in paragraph 10 of the report. The report of the Fi fth Committee on the financial irnpli cations for the progranme budget of the draft resolution is in document A/4l/9l4. Under this draft resolution the General Assell'bly, among other things, would decide that the Special Conunittee shall oomplete a draft declaration on the enhancement of the effectiveness of the principle of non-use of force in international relations, including, as appropriate, recoJllllendations on the peaceful settlement of disputes. It would also decide that the Special Committee shall hold its session for a period of three weekS in 1987 and informal oonsultations at the appropr iate time to enable the work to be comple ted. I understand that agreement has been reached with regard to the dates of the forthcoming session of the Committee, namely, from 9 to 27 March 1987, in New Yor:k. The Sixth Cornrnittee adopted the draft resolution without a vote and it is hoped that the General Assell'bly will do the same. I t'~'~n now to item 127 of the agenda, "Report of the united Nations Conunission on International Trade Law on the work of its nineteenth session". The report of the Sixth Conuni ttee is in document A/4l/86l. According to the terms of the draft resolution, which the sixth Committee recommends for adoption by the General (Mr. Castroviejo, Rapporteur, Sixth Committee) AsseJl'bly, in paragraph 7 of that report, the united Nations Commission on International Trade law would, among other things, complete at its twentieth session the work on the draft convention on international bills of exchange and international promissory notes. The Sixth Conunittee adopted that draft resolution wi thout a vote and we trust that the General Assenbly will do likewise. I now turn to the report of the Sixth COlll1littee 1 /41/891) on item 128, entitled "Consideration of effective measures to enhance the protection, security and safety of diplomatic and consular missions and representatives". Paragraph 10 contains draft resolutions which the Sixth Committee recommends to the General Assembly for adoption. In accordance with the prCNisions of draft resolution I, the General Assellbly would strongly condemn acts of violence against diplomatic and consular missioos and representatives, as well as against missions and representatives to international, intergCNernmental organizations and officials of such organizations, and, emphasize that such acts can never be justified. Furthermore, the General Assenbly would not only maintain but further strengthen the procedures for reporting on violat~ons adopted in earlier resolutions. Through resolution 11, entitled "'lWenty-fifth anniversary of the Vienna Convention on Diplomatic Relations", the General Assellbly, among other things, would reaffirm its conviction of the essential role that the Vienna Convention on Diplomatic Relations has played for CNer 25 years and will continue to play in prol'lOting co-<>peration and understanding among Sta tes, in creating normal conditions for the activities of diplomatic missions and representatives and in the progressive development of international law in this field, and call upon all states to observe strictly the prCNisions of the Convention in order to create an appropriate atmosphere essential for the normal discharge by diplomatic missions of their functions. (Mr. CastrCNiejo, Rapporteur, Sixth Committee) It is my hope that, like the Sixth committee, the General Assembly will adopt both draft resolutions without a vote. With regard to item 129 of the agenda, concerning the report of the Ad Hoc Committee on the Drafting of an International Convention against the Recruitment, Use, Financing and Training of Mercenaries, the relevant draft resolution, which was adopted by the committee without a vote, is in paragraph 11 of the Sixth Committee's report (A/41/872). The report of the Fifth Committee on the financial implications for the programme bUdget of that draft resolution is to be found in document A/41/922. According to the provisions of the draft resolution, the General Assembly would, among other things, decide to renew the mandate of the Ad Hoc Committee to enable it to continue its work on the drafting of an international convention and request it to make every effort to fulfil the mandate entrusted to it by the General Assembly and to proceed with all deliberate speed with drafting a convention. With regard to the 1987 session of the Ad Hoc Committee, it was agreed that it should meet from 19 January to 6 February 1987. I hope that the General ASsembly, like the Sixth Committee, will adopt this draft resolution without a vote. I turn now to agenda item 130, "Report of the International Law Commission on the work of its thirty-eighth session". The draft resolution that the Sixth Committee recommends to the General Assembly is to be found in paragraph 7 of its report in document A/41/892. That draft resolution contains the usual language giving the Commission such guidelines as to continue its work on the topics in its current programm~ and reaffirming the Assembly's previous decisions concerning the documentation of the Commission - including the provision of summary records for its sessions - and the increased role of the Codification Division of the Office of Legal Affairs. We should highlight two new paragraphs. First, in paragraph 5 the Assembly would reauest the International Law Commission to consider thoroughly the planning of its activities for the term of office of its members, bearing in mind the desirability of achieving as much progress as possible in the preparation of draft articles on specific topicsJ and its methods of work in all their aspects, bearing in mind the possibility of staggering the consideration of some topics. The Commission would also be reauested to indicate in its annual report those subjects and issues on which expressions of views by ~overnments, either in the Sixth Committee or in written form, would he of particular interest for the continuation of its work. Under paragraph 6 of the draft resolution - which is also new - the Assembly would take note of the comments of the International Law Commission on the auestion of the duration of its session, and would express the view that the needs of the work of codification and progressive development of international law and the magnitude and complexity of the subjects on the agenda of the Commission make it desirable that the usual duration of its sessions he maintained. I trust that, like the Sixth Committee, the General Assembly will adopt this draft resolution without a vote. (Mr. Castroviejo, Rapporteur, Sixth Committee) The Sixth Committee's report on agenda item 131, "Report of the Committee on Relations with the Host Country", is contained in document A/4l/893. ~aragraph 7 of that report reproduces the draft resolution that the Sixth Committee recommends for adoption by the Assembly. Under that draft resolution, the General Assembly would, among other things, urge the host country to take all necessary measures without delay in order to continue to prevent any criminal acts, including harassment and activities violating the security of missions a~ the safety of their personnel or the inviolability of their property. The Assembly would also urge the host country and the Member States that raised the issues in response to the reauest and action by the host country to reduce the size of their missions to follow tbe path of consultations with a view to reaching solutions to this matter in accordance with the Agreement between the United Nations and the United States of America regarding the Headauarters of the United Nations. Since the Sixth Committee adopted that draft resolution without a vote, it is to be hoped that the Assembly will also do so. In paragraph 13 of its report in document A/4l/894, on agenda item 132, the sixth Committee recommends to the General Assembly a draft resolution entitled "Report of the Special Committee on the Charter of the united Nations and on the Strengthening of the Role of the Organization". The report of the Fifth Committee containing the programme budget implications of the draft resolution is to be found in document A/4l/923. Under the provisions of the draft resolution, the General Assembly would, among other things, decide that the Special Committee should hold its session for a period of three weeks early in 1987, reauest the special Committee to accord priority, by devoting more time, to the auestion of the maintenance of international peace and security in all its aspects, to continue its (Mr. Castroviejo, Rapporteur, Sixth Committee) work on the auestion of the peaceful "settlement of disputes between States~ and t.o keep the auestion of the rationalization of the procedures of the united Nations under active review. It would also reauest the Secretary-General to continue the preparation of a draft handbook on the peaceful settlement of disputes between States. with regard to the 1987 session of the Special Committee, agreement has been reached on the period of 9 to 27 February. The Sixth Committee adopted this draft resolution without a vote. I trust that the Assembly will also be able to do that. The report of the Sixth Committee on agenda item 133, "Development and strengthening of good-neighbourliness between States", is in document A/4l/895. Paragraph 11 of the report contains the draft resolution that the sixth Committee recommends to the Assembly for adoption. Under the provisions of that draft resolution, the General Assembly would, among other things, reaffirm that the generalization of the long practice of good-neighbourliness and of principles and rules pertaining to it is likely to strengthen friendly relations and co-operation among States in accordance with the CharterJ take note of the report of the SUb-Committee on Good-Neighbourliness, which functioned within the Sixth Committee during the forty-first session of the General Assembly~ and decide to continue and complete at the fo~ty-second session, on the basis of the present resolution and of the report of the SUb-Comrnittee, the task of identifying and clarifying the elements of good-neighbourliness within the framework of a sub-committee on good-neighbourliness. I hope that the General Assembly, like the Sixth Committee, can ~dopt this draft resolution without a vote. I turn next to agenda item 134, "Draft body of principles for the protection of all persons under any form of detention or imprisonment". The report of the sixth Committee on that item is contained in document A/4l/896. The Sixth (Mr. Castroviejo, Rapporteu~, Sixth Committee) Committee adopted the draft decision contained in paragraph 10 of that report without a vote, and I trust that the Assembly also will do that. With regard to agenda item 135, "Draft standard rules of procedure for united Nations conferences", the Sixth Committee adopted, also without a vote, the draft decision contained in paragraph 6 of its report in document A/41/897. I hope that the General Assembly too will adopt this draft decision without a vote. I come now to agenda item 136, "Draft declaration on social and legal principles relating to the protection and welfare of children, with special reference to foster placement and adoption nationally and internationally". The Sixth Committee's report on that item is contained in document A/4l/898. As representatives will recall, the item originated in General Assembly resolution 3U28 (XXVII). At the beginning, the Assembly allocated this item to the Commission for Social Development, Rhich in 1979 reported to the Economic and Social Council on its work. In the same year, the Ecc'omic and Social Council submitted the draft declaration to the Assembly. The item was first considered in the Third Committee and then, in 1982, was allocated to the sixth Committee so that it could complete the final stages of the draft declaration. I am extremely pleased to inform the Assembly that this lengthy, 24-year history has now come to a successful end. After a series of informal consultations held in the Sixth Committee to overcome the obstacles created as a result of the differing approaches to the matter taken in various legal systems 3 the Committee completed the draft declaration, which contains a preamble and 24 articles and is annexed to the draft resolution reproduced in paragraph 8 of the Sixth Committee's report. The Committee adopted the draft resolution without a vote, and I hope that the Assembly will also do so. Finally, I turn to agenda item 138, "Vienna Convention on the Law of Treaties between States and International Organizations or between International (Mr. Castroviejo, Rapporteur, Sixth Committee) Organizations". The draft decision on this item that the sixth Committee recommends to the General Assembly for adoption is contained in paragraph 7 of the report in document A/4l/899. The draft decision was adopted by 87 votes to 1, with 23 abstentions. Under its provisions, the General Assembly would welcome the adoption, on 20 March 1986, by the united Nations Conference on the Law of Treaties between States and International Organizations or between International Organizations, of the Vienna Convention on the Law of Treaties between States and International Organizationa or between International Organizations; would consider that the Convention should be signed on behalf of the United Nations; and would express the hope that States, as well as international organizations that have the capacity to conclude treaties, would consider taking the steps necess~ry to become parties to the Convention at an early date. As I conclude my work as Rapporteur of the sixth Committee, I should like to address some words of thanks and appreciation to the menbers of the Cormnittee, whose hard work and competence have made it possible to present this group of draft resolutioos and decisioos to the General Assembly today for adoption. In partioular I should like to thank the Chairman of the Committee, Mr. Laurel Francis, for the wise manner in which he conducted the Cormnittee's d~ates, with the very valuable assistance of the two Vice-Chairmen, Mr ~ Jose wis Jesus and Mr. loan Voicu. The excellent legal and diplomat skills of those three re presentaUves have been clearly displayed in the discharge of their mandates. Russian): In joining the consensus on deaEt resolution 1 in document A/41/75l, the
delegation of the USSR would like to call attention to a new soviet proposal along
the same lines as the one set forth in the draft resolution we have just adopted.
Speaking before the Indian Parliamant on 27 November, the General Secretary of
the Central Committee of the Communist Party of the Soviet Union,
Mikhail Gorbachev, proposed the establishment, with the assistance of the leading
space Powers, of an international centre for joint research and development in
space technology, in :esponse to the reauests of the developing countries for
access to such technology - for example, to satellites for the study of natural
resources. Such a centre would comprise facilities for training specialists from
developing countries, inclUding cosmonauts, as well as a testing range for the
launching of space objects.
That initiative embodies our deep conviction that outer space, as the common
heritage of mankind, should be used solely for peaceful purposes and that the
development of broad international co-operation in the peaceful conquest of outer
space is the only sensible alternative to the extension of the arms race into outer
space. Of particular. importance in this regard are projects calling for
international co-operation in providing genuine assistance to developing countrie~
in order to involve them as fully as possible in the use of the achievements of
space science and technology.
The peaceful conauest and uses of outer space are causes that involve all
mankind, and not the prerogative of the developed countries alone. That is the
essence of our basic position and of our proposal for a step-by-step implementation
of a "Star Peace" programme, as contained in the new Soviet proposal put forward by
Mr. Gorbachev.

legally, in the General Assembly we do not have a system of adoption of decisions
by consensus but that we should say "without a vote". It is just a point of
clarification.

Rapporteur of the Special Political Committee indicated, this. draft resolution was
adopted by consensus in the Committee and that, to my delegation at least, has a
significance; so if there is no real legal objection I would ask you, Sir, to
continue on the basis that you had indicated - that the Assembly adopt this draft
resolution by consensus as well.
An impor.tant legal question has been raised. Does the
delegation of Mexico insist upon whether the draft resolution is adopted "by
consensus" or "without a vote"?
I am advised that it is true that it is not customary for draft resolutions to
be adopted by consensus in the General Assembly, but there is nothing to prevent
the Assembly's taking a decision by consensus if the members so wish.

in a position to object to your decision, Sir, nevertheless I want to make it quite
clear that Mexico understands that draft resolutions adopted in this way are
adopted "without a vote" and not "by consensus".
It is not my decision. The Rapporteur of the Special
Political Committee has said that the Committee adopted the draft resolution by
consensus, and that has been confirmed by the representative of the Federal
Republic of Germany.
I am in the hands of the General Assembly as to whether it wishes to adopt the
draft resolution by consensus.. That is quite normal. There is 'tlothing to prevent
the General Assembly's adopting a draft resolution by consensus, since it was
adopted by consensus in the Special Political Committee.
The representative of the Federal Republic of Germany has requested me, as
President of the General Assembly, to continue with the Assembly's adoption of this
particular draft resolution by consensus. Unless that is formally objected to by
the representative of Mexico, we shall adopt the draft resolution by consensus.

A/41/889 on agenda item 124, entitled "Peaceful settlement of disputes between
States".
I shall now call on those delegations which have asked to explain their vote,
or their position.
Mr. ~IQJ (Romania) (interpretation from French): My delegation recently
held informal bilateral consultations with the delegati"ons which abstained on the
draft resolution contained on pages 8 and 9 of document A/41/889. My delegation
optimistically coocluded from those consultations that there was a real chance to
reach a consensus on this draft resolution, in keeping wi th the established
tradition in the Sixth Committee. '1'0 my surprise, today 1 learr_ed that there will
be a request fot a separate vote on operative paragraph 5. The meaning of this
request is quite simple. In the Sixth Committee, consensus was broken on the whole
draft resolution. That was ll.ct 1. Now we have kt 2, an attempt to prevent a
consensus on operative paragraph 5, on which we did indeed have a consensus in the
Sixth Committee. In this regard, I invite delegations to read paragraph 13 of
document A/4l/889 which states that;
"The sub-amendment of R)mania was adopted without a Yote. As a result,
the amendment of Canada, mdified by the sub-amendment of ROman ia, was
incorporated as operative paragraph 5 in draft resolution A/C.6/41/L.2. No
vote was taken on the amendment of Canada." (A/4l/889, p. 6, para. 13)
My delegation had the oppor tunity to take a stand on the substance of this
question in the Sixth Committee. Let me just take up two aspects.
First, the draft re9olution - especially operative paragraph 5 - speaks of the
peaceful settlement of displtes. This is a separate and topical subject; one of
great importance in international life today. Any attempt to question the
legitimacy of the presence of this item on the agenda can only be interpreted as a
basic reservation on a fundamental principle of the United Nations Charter. This
reservation can only concern the very pzocess of the peaceful settlement of
disputes through the ~ogressive developnent and codification of international law
and by increasing the effectiveness of the united Nations in this area.
secondly, the considerations expressed in the Sixth Committee on the deletion
of this item from the agenda for reasons of rationalization are groundless, and all
menbers know why. Indeed, the question of the peaceful settlement of disputes, has
always been considered in combination with the item concerning the report of the
Special Committee on the Charter and on the strengthening of the role of the
Organization. This practice proved successful and caused no difficulty to anyone.
This way of discussing the two i terns created no problems for ei ther agenda item.
That is .,,:.y it seems to my delega tion that all the conditions for not ask ing for a
separate vote 00 paragraph 5 of the draft resolution concerning the peaceful
settlement of disputes had been met.
Therefore, I appeal to delegations which asked, or intend to ask, for a
separate vote on this paragraph, not to insist on that request. It is an appeal to
restore consensus on operative paragraph 5 of the draft resolution. It is a
consensus which we had in the Sixth Committee and which we would like to maintain
when we deal with the final adoption of the draft resolution in the plenary
Assenbly.
MC. SCHRICKE (France) (interpretation from French): When in the Sixth
Committee the draft resolution on the peacefUl settlement of disputes was
considered, an amendment to operative paragraph 5 of the text was submitted by
Canada. The Romanian delegation then deemed it necessary to submit a
sub-amendment, and my delegation itself submi tted a sub-amendment to the Romanian
sub-amendment. The purpose of this battle of amendments was only to know whether
the peaceful settlement of disputes should be maintained as a separate item on the
agenda, which is the Romanian delegation's position, or whether it was preferable
for the sake of the rationalization of the wor k of the Assembly.. to consider this
question under the item devoted to the consideration of the report of the special

Conunittee on the Charter. That is the view of a considerable nul'lber of
delegations, including ~ own.
The sub-amendment proposed by France was not adopted by the Sixth Committee
which, in a second vote, took a decision on the draft resolution as a whole,
whereas this subject, as the representative of R)mania reminded us, was usually
contained in a draft resolution adopted without a vote by the Sixth Committee. The
vote on the draft resolution as a whole was prorrpted by the inclusion of operative
paragraph 5 in the draft resolution which provides that the question of the
peaceful settlement of disputes is to be considered as a separate agenda item at
the next session of the General Assel'lbly.
On behalf of the 19 delega tions which in the Comittee voted in favour of the
sub-amendment submitted by my delegation, I should like to recall that we feel that
the question of the peaceful settlement of disputes should not be a separate agenda
item, because it is dealt with by the Special Committee on the Charter. The
Special Committee's report is itself the subject of a separate agenda item. It is
under that item that this question should therefore be examined. In fact, for
several years now these two questions have been considered together and the wording
proposed for paragraph 5 merely draws the consequences of this practice, while
maintaining the existence of two separate items, contrary to all logic. We do not
lmderstand the reasons given, in this particular case, for refusing to follow the
recomnendations of the Assembly in favol1r of col'lbining agenda items, submitted by
the Afro-Asian Legal Consultative COIl1llittee.
Our delegation's ooncern is p"drely one of rationaliZing the procedures of the
Assenbly, and we have no objections to the substance of the draft: resolution before
us. That is why we decided, so that there would be no anbiguity about our

position, to ask for a separate vote only 00 paragraph 5 of the draft resolution,
while associating ourselves with the adoption of the text as a whole, without a
vote. There would thus be only one vote in tile plenary Assell'bly, whereas there
were two votes in the Sixth Committee. Therefore, we she'll! abstain in the voting
00 paragraph 5 and we hope that the delegations which share our concern will do
likewise.

support the principle of the non-use of force in international relations.. As the
victim of the use of force and ndced aggression by the Iraqi regime on
22 September 1980 .. my delegation wishes to register its reservations regarding
co-sponsa:ship of that draft resolution by Iraq, a regime that has flagrantly
violated the very founc1ations of the draft resolutiaA in document A/41/860.

Mr. TlMERBAEV (Union of Soviet Socialist Republics) (interpretation from
Russian): The Soviet delegation wishes briefly to explain its position on the
resolution just ad~pted on the report of the Special Committee on the Charter of
the United Nations and on the Strengthening of the Role of the Organization.
As noted in the letter from the Soviet delegation on the development of
international law (A/C.6/41/5), the circumstances of our time demand not only
strict compliance by all States with the existing principles and rules of
international law but also a new mode of legal thought. They also require the
further qualitative development of international law. Thus the activities of the
United Nations take on even greater importance.
Ad.dressing the Indian Parliament recently, the General-Secretary of the
Central Committee of the Communist party of the Soviet Union, Mikhai1 Gorbachev,
said:
"We are convinced that in this nuclear space age, the united Nations -
which brings together 159 States - can and must increase its contribution to
strengthening peace, as envisaged at the time of its foundation. FOr that
purpose it must above all increase its contribution to the formation of new
modes of political thought and action.
"The Soviet Union advocates that more effective use be made of the
potential of this universal Organization than has been made in the past,
inter alia through the democratization of its work and of its basic organsr"
In the view of the Soviet Union, it is important that the fullest possible use
be made of all the means provided for in the United Nations Charter for the
peaceful settlement of disputes between Statesl through negotiation,
investigation, mediation, conciliation, arbitration, jUdicial proceedings and
referral, by agreement, to regional bodies. We advocate the fullest possible
enhancement of the role of the United Nations and the strengthening of its
political, legal and moral status.
For all those reasons, the Soviet delegation supported the draft resolution
just adopted by the Assembly.
